NAB Lahore Amendment Ordinance challenged in Lahore High Court
The NAB Lahore Amendment Ordinance presented by the government has been challenged in the Lahore High Court. The petitioner, taking the government as a party, took the position that the NAB Amendment Ordinance 2021 is against the decisions of the Lahore High Court (Website). The ordinance was not issued in the presence of Parliament. The term of the Chairman NAB cannot be extended as per the law, therefore the NAB Amendment Ordinance 2021 is illegal and unconstitutional.
The petitioner said that the power to legislate belongs to the Parliament, the ordinance cannot be issued to any one individual, therefore the court is requested to stay the implementation of the NAB Lahore Amendment Ordinance till the final decision of the petition. The NAB Amendment Ordinance 2021 should be repealed.

The Dhar NAB Ordinance has got final legal status under which the current Chairman NAB will be able to continue his work till the appointment of a new Chairman. The NAB Ordinance has been included in the Gazette of Pakistan. The status of the law has been achieved, under which the existing NAB will be able to continue its work till the appointment of a new chairman. As a result of the gazette notification, the NAB Ordinance has been formally enacted.
It should be noted that the President has issued the National Accountability Second Amendment Ordinance 2021. According to the Amendment Ordinance, the President will establish as many accountability courts in the country as he wants. The appointment of judges for accountability courts will be for three years. The President will appoint the Chairman NAB in consultation with the Prime Minister and the Leader of the Opposition. According to the ordinance, the current chairman NAB will continue his work till the appointment of a new chairman. The term of office of the new chairman NAB will be four years. According to the ordinance, the parliamentary committee will consist of 12 members. NAB chairman can be removed just like Supreme Court judges, NAB chairman can send his resignation to the president. NAB law will not apply to federal, provincial and local taxation matters will not be under the jurisdiction of NAB, tax matters have been removed from the jurisdiction of NAB Lahore.
According to the ordinance, the decisions of the Council of Common Interests, NEC, NFC, ECNEC are also outside the jurisdiction of NAB Lahore , the decisions of CDWP, PDWP will also be outside the jurisdiction of NAB.
